Abstract: 

Two recent developments have given cause for cautious optimism for the advocacy community of committed persons in Minnesota. First, it appears that the long dearth of discharges from sex offender commitments may be coming to an end. Until recently, advocates for committed sex offenders pointed to the fact that none of the persons committed to the Minnesota Sex Offender Program had been discharged from that program. Sex offender commitments accelerated in the early part of the 1990s when the old Psychopathic Personality commitment was used to detain men who were coming to the end of their sentences. The history of the various challenges to the constitutionality of these commitments is by now quite familiar to anyone involved with sex offender litigation.
