Abstract: 

This is the seventh article in an ongoing series based on Dr. Koski’s “Jury Decisionmaking in Rape Trials: A Review and Empirical Assessment,” which appears in its entirety in 38 (1)Criminal Law Bulletin 21 (Jan/Feb 2002), and is reprinted in SLR with the kind permission of the author and publisher. The article below details the study methodology and analytic design, including the demographics of the subjects. It sets forth the first of Koski’s four hypotheses of juror decisionmaking, which predicted that individual-level (predeliberation) not-guilty votes would be positively related to the victim’s failure to achieve legitimate victim status, as measured by prior relationship. The article analyzes jury outcomes based on this model.
