Abstract:
Privacy protections of crime victims—what few and however infirm those protections are—have been eroding since they were initially imparted to crime victims as part of the reform of sex crimes laws in the 70s and 80s. In recent years, they have been circumvented by a scandalhungry media, in what has been a journalistic tradition, and by zealous defense attorneys. This first installment of a multipart article launches the discussion from the Kobe Bryant case, which was among the most disturbing examples of violations of victims’ protections on record. Whether the circumstances of the sexual intercourse that took place in that Colorado hotel room meet the standard for rape will never be known because Bryant’s legal team intimidated the accuser into silence.Keywords:
