Abstract:

Gael Strack and Casey Gwinn, along with attorney Gerald W. Fineman, J.D., and a retired detective, Michael Agnew, examine how to effectively draw out the evidence and present the facts in criminal proceedings against defendants accused of strangulation. They observe that proving the act of strangulation shares challenges in common with other domestic violence crimes, such as establishing who was the primary aggressor (since a woman who is being strangled by her partner may fight back, injuring the perpetrator) and persuading victims to participate in the legal process throughout the unfolding of the criminal case. They address these and other challenges with the wisdom they gained through their hard work in the trenches prosecuting these deplorable crimes.
