Abstract: 

The ADEA has been in existence for more than 40 years but there are still matters of interpretation that remain unsettled. With the U.S. facing an aging workforce, there will likely be a marked increase in future discrimination claims under the ADEA and courts, the EEOC and lawmakers in Congress will all have to provide employers and others with further guidance regarding the Act. Recent decisions have filled some of the gaps.
