Abstract:

Our lawmakers and courts were besieged when the foreclosure crisis began to wash over the country and clog the system in 2008. Under pressure to clear the decks, many jurisdictions knee-jerked solutions that seemed to favor borrowers over lenders. But many more went the other way and backstopped lenders. Now that the wave of foreclosures has subsided to a more manageable degree, pro-lender sentiment may be waning. Recent developments in Connecticut seem to be a sign this is indeed happening.
