Abstract:

In 2008 in District of Columbia v. Heller and again in 2022 in N.Y. State Rifle & Pistol Assoc., Inc. v. Bruen the Supreme Court endorsed new standard for determining the constitutionality of laws regulating guns. Since then, a number of laws that had survived challenge under previous interpretations of the Second Amendment are now falling under the Heller and Bruen standards. In this article, DVR’s case analyst Annie L. Perry reviews the current Second Amendment landscape and how federal district and appeals courts are ruling in a broad range of gun cases nationally.
