Abstract:
Mitchell v. McKeithen upholds a district court ruling granting summary judgment to reject claims against a jail nurse and sheriff for failure to diagnose a stroke that proved fatal to a detainee in the Bay County Jail in Florida. The case is interesting for practitioners because the question wasn’t a matter of misdiagnosis of the inmate’s alarming symptoms, but rather the failure of either the nurse or jail staff to seek an expert’s assistance in diagnosing the inmate’s condition, which according to a forensic pathologist’s testimony, could have saved his life.Keywords: Americans with Disabilities Act; Deliberate Indifference Standard
