Abstract:
Curry County, N.M. Jail confined a seriously mentally ill detainee in isolation for eight months without a hearing, assessement, or any kind of review. We examine the facts and legal reasoning of the federal judge who ruled in favor of the detainnee and against the jail, allowing a lawsuit to proceed to trial (or settlement—likely to be in the millions of dollars). Keywords: Solitary confinement
