Abstract:
Lawyers seek to overturn a death sentence imposed for a death in the commision of a robbery arguing first, that under Supreme Court precedent Moore clearly qualifies as sufficiently intellectually disabled and is therefore exempt from execution. And second, counsel argues that the excessive time served under the sentence of death, and especially with so many years in harsh segregation, violates the Eighth Amendment and creates immunity from the death penalty.Keywords: Atkins v.
