Abstract:

After repeated incidents of non-compliance and increasingly erratic behavior, followed by repeated evaluations that indicated no need for treatment by a qualified mental health professional (QMHP), a 19-year old jail inmate was founding hanging in his cell. A federal district court has denied defendants’ motion for summary judgment, ruling that jury could reasonably render a finding of deliberate indifference given the facts of the case, which we examine here.
