Abstract: 

Federal courts recognize psychotherapist-patient privilege, and also recognize the privilege may be voluntarily waived. In U.S. v. Lara, 850 F.3d 686 (4th Cir. 2017) the Plaintiff maintained that when faced with a choice of conditional freedom or 20 years’ imprisonment, choosing to waive patient-therapist privilege was hardly voluntary.
