Abstract:
Juries in courts around the world have been asked to determine whether fear of domestic abuse should have any effect on the outcome of a trial for drunk driving. That battered women’s syndrome affects the mind is a theory that was accepted first by the Massachusetts Supreme Judicial Court in 1994 and its application in DUI/DWI cases has been cautiously permitted in cases around the globe.
