Abstract: 

Colleges and other educational institutions learn a great deal about their students. If that information were to fall into the wrong hands, that might result in great harm. To prevent this outcome, Congress created the Federal Education Records and Privacy Act (FERPA). FERPA does not create a private right of action in favor of students whose records are unlawfully disclosed to others. However, colleges that fail to comply with FERPA could face sanctions imposed by the U.S. Department of Education. This article, in question-and-answer format, will hopefully help the reader digest this fairly complex statute.
