Abstract:

This article is a continuation of our look at the evolving law of bystanders in the college campus setting, which appeared in 4 (6) CS&SD 81 (July/August 2003). This part of the article discusses how the threat of violence by students is assessed and the concomitant question of how “threat” is defined. The article further analyzes the legal ramifications associated with bystander knowledge, including confidentiality of the source, institutional actions, and institutional policy implications.
