Abstract: 

Many commentators could and should speak to the implications of a request to maintain the privacy of a sexual assault, including Clery Act reporting, requirements to investigate under Title IX, and duties to warn under federal and state law. This article confines itself to a narrower scope, by focusing exclusively on the issue of the duty of college and university officials to report felonies about which they have knowledge. Many states have what are called felony reporting statutes. They impose upon citizens who become aware of the commission of felonies the duty to report them to appropriate law enforcement authorities. Largely, these laws are not enforced, though they remain on the books. These are laws that are separate from those that impose duties on state officials to report child abuse involving minors.
