Abstract:

Title IX of the Education Amendments of 1972 (20 U.S. Code Secs. 1681–1688) has enabled women to make great strides in both the academic and athletic aspects of college life. A school that receives federal funds must provide equal opportunities for male and female students. The U.S. Department of Education, Office of Civil Rights (OCR), has promulgated regulations that provide guidelines for Title IX compliance regarding athletic programs. OCR sets forth factors used in comparing male and female athletic programs (34 U.S. Code Sec. 106.41[c]). This article reviews some of the key principles and challenges in complying with Title IX.
