Abstract:

In Bash v. Clark University , 2006 WL4114297 (Mass. Super.), a father sued the college for wrongful death after his daughter died from a heroin overdose. The daughter (Ms. Bash) died on campus after using heroin. Defendants were Matthew Book, a fellow student of Ms. Bash and the alleged supplier of the heroin, and eight university officials who were alleged to have been negligent in failing to take preventive steps to protect Ms. Bash. In addition, the father alleged that university officials misrepresented to him that Ms. Bash would be provided with a safe and healthy environment while at Clark.
