Abstract:

Colleges, perhaps motivated in part by pronouncements by the Department of Education or Department of Justice regarding Title IX, are tightening their definitions of what constitutes consent. However, since an erroneous finding of guilt on a sexual misconduct charge can destroy a male student’s career or even his life, every effort must be made to protect the rights of male students who maintain their innocence.
