Abstract: 

In September 2017, the National Association for College Admissions Counseling (NACAC) published the “Principles of Good Practice: NACAC’s Code of Ethics and Professional Practices (Code). According to an article by Scott Jaschik in Inside Higher Education, the Department of Justice has sent a letter to the NACAC indicating that it is looking into possible antitrust implications of the Code of Ethics. This article summarizes some of the key principles described in the document, provides background on U.S. antitrust laws and their applicability, and examines provisions of the Code dealing with early decision, confidentiality of application, admission, and acceptance decisions, and incentives.
