Abstract:

U.S. Education Secretary Betsy DeVos has promulgated new guidelines that interpret the Title IX requirements for colleges dealing with allegations of sexual assault. The guidelines make some changes in the procedures that colleges and universities should follow, but the guidelines still leave schools with wide discretion as to how to handle allegations of sexual misconduct. The September 2017 publication of the DOE appears as a series of questions and answers. We describe some of the key provisions below.

Keywords: School Responsibility to Address Sexual Misconduct; Clery Act Obligations; “Prompt” and “Equitable” Investigations and Interim Measures; Procedures for Adjudicating a Finding of Responsibility
