Abstract: 

On February 22, 2017, a month after Donald Trump took office as President, OCR issued a “Dear Colleague” letter that effectively withdrew the guidance provided by a 2016 “Dear Colleague” letter concerning the rights of transgender students, rescinding a provision giving transgender students the right to use bathrooms and locker rooms consistent with their own gender identity. This article discusses some cases decided before and after the issuance of the February 2017 DOE letter. Most involve high school students rather than college students, but it is probable that Title IX would mandate the same result in college cases as nothing in Title IX specifically distinguishes between high school and college students.
