Trump’s Campaign Rhetoric Comes Back to Bite Him as Fourth Circuit Appeals Court Puts Travel Ban on Hold

Abstract:
In International Refugee Assistance Project v. Trump, 2017 WL 2273306 (4th Cir., May 25, 2017), the Fourth Circuit Court of Appeals published an opinion that essentially put on hold President Donald Trump’s Executive Order that banned travel from certain Middle Eastern and African countries. Although multiple constituencies are, for good reason,challenging the Executive Order, the Fourth Circuit opinion has particularly important implications for colleges that want to enrich their communities by welcoming students and faculty from all over the world. This article examines the arguments and decision in the case, with special emphasis on issues of importance to higher education.Keywords: Lemon v. Kurtzman; Kleindienst v.
