Abstract:

The Office of Civil Rights (OCR) recently entered into an agreement with Wesley College that resolved a Title IX complaint. The agreement contains some useful language that colleges may want to incorporate into their own policy manuals. Moreover, this was a rare case in which OCR both found that certain male students who were accused of sexual assault were unfairly treated and got the university to agree to remedial action. The following article is a summary of the key provisions.

Keywords: Title IX; sexual misconduct; Federal Educational Privacy and Records Act, “FERPA”; hostile environment; cross-examination; sharing information; sexual history; training for board hearing panel members; training for students
