Abstract:

A student challenges his suspension by means of a claim under Title IX, contending that because of the backlash from those who believed that Columbia was too lenient in its treatment of men accused of sexual assault, he was treated unfairly, and more harshly, because of his sex. The complaint sought damages plus expungement of his disciplinary record. The District Court dismissed the action, but the Second Circuit Court of Appeals recently reversed the decision and reinstated the complaint.
