Abstract: 

Penological Legitimacy of Tuberculosis Testing Upheld. The judiciary is continuing to uphold the penological legitimacy of those policies that require all inmates to undergo testing for tuberculosis. A controversy can arise if the test used involves the injection of a purified protein derivative. Some religions, including Rastafarianism, prohibit the ingestion of meat. This was the issue in the New York case of Rossi v. Portuondo, 714 N.Y.S.2d 816 (3d Dept. 2000).
