Abstract: 

As most practitioners know, managing a person with special mental health needs is constantly in a state of evolution. Corrections is similarly in a state of evolution as the pendulum swings between punishment and rehabilitation. The union of the two for centuries has caused much concern and confusion due to the nature of the separate disciplines. Beccaria (1738-1794), a published scholar on crime and punishment, identified the need to manage the needs of the mental health societal offender different from other convicted person because they do not have the capacity to assess the risk of their behavior. The New Jersey Criminal Justice System in 2003 continues to struggle with this population management, especially since the de-institutionalization movement of the 1990s.
