Abstract:
Orthopedic problems experienced by prison inmates, whether they arise from an injury or a long-standing condition, often present challenges regarding both the diagnosis and the choice of treatment. A delay in providing medical treatment, without more, generally will not support a claim of deliberate indifference. Similarly, plaintiff inmates have been unsuccessful with allegations of deliberate indifference based on the failure to provide them with a particular orthopedic appliance. A different result was almost reached in the same circuit regarding an inmate’s need for a wheelchair. Keywords: Forstner v. Daley, Rose v. Beckham, Bieber v. Wisconsin DOC, Wetzel v. Sheahan
