Abstract: 

Protecting Against “Unhealthy Environments” in Prisons. Thomas Powers, a federal prisoner, brought a pro se civil rights action against the warden and others in the facility in which he was incarcerated based upon his assignment to work in an unhealthy environment where he could be exposed to hepatitis and, also, because he was required to receive inoculations against that disease. Negligence Claims Against the United States Watson v. U.S., 2007 U.S. App. LEXIS 10526 (10th Cir. May 4, 2007) dealt with a claim against the United States under the Federal Tort Claims Act that was initiated by Katherine Dorothea Watson as guardian for Kortney LaMon Lewis, an incapacitated former federal prisoner. Right to Receive Services Inmates who were confined at the Montana State Prison (MSP) prior to 1999 and subsequently transferred to regional and private prisons brought a class action alleging that the transfers were unlawful under Montana constitutional provisions dealing with cruel and unusual punishment, individual dignity, and reformation because those facilities did not provide inmates with opportunities for treatment, training, and rehabilitation that were comparable to those at MSP.
