Abstract: 

In Marquez. v. Woody , 440 Fed Appx. 318 (5th Cir. 2011), the court dealt with some highly dubious policy and decisions involving dental care for a Texas prisoner. It is undisputed that inmate Marquez does not have any teeth; none. He has been repeatedly denied dentures, however, because his body mass index (BMI) was in the normal range of 18.5 to 25. We examine the policy and the court’s ruling allowing the case to proceed to trial.
